This means that unless you can produce such an agreement, this alleged debt is not enforceable in law.  You had until the 7th of March 2009 to provide me with the true copy I requested. After that date you entered into default of my request. The time limits, which are laid down in the Consumer Credit (Prescribed Periods for Giving Information) Regulations 1983 are clear. You must supply an executed credit agreement within 12 working days of a proper CCA request. If you fail to comply with a legitimate request the account enters a default situation and if you fail to comply after a further 30 days you commit an offence. I feel that if a security camera were present it would establish how a small minority of your staff intimidate customers &amp; junior members of staff into verbally mistreating customers via the telephone. After 7 hours of ringing customer service and being humiliated I have no doubts in my mind that if a member of staff were to acknowledge and verify that my treatment was inhuman that they would only serve themselves with the punishment of losing their career&amp;rsquo;s and their future with your company.  I only rang customer service to establish if I could borrow or have replaced a blu ray system which we bought in Aug/ Sept 08 and which had only been repaired in October 09. The engineer turned up at our home in Dec 08 but due to the presents we had bought our young old son for Christmas we were unable to allow him to take the blu ray away until after Christmas. I tried to explained to the customer service dept., that after the first repair of the blu ray which was repaired in Oct 08 in our home after having had to wait about 3 weeks for the part to arrive at the repair companies depot , that I had reported the blu ray not working properly again 2 days later Oct 08 . I established that since Currys had changed over repair companies that our records were lost. I was informed that I had according to their computer, only rang customer service in mid December 08 reporting the fault. Therefore I was not eligible to a replacement blu ray.  I did not at this point realise that since we had taken out the extended warranty that we were entitled to a replacement because no engineer had arrived within 28 days of reporting a fault. I can prove that I did not ring customer service in mid Dec 08. (I am only assuming the entry on your computer must have been when someone updated our records) However I can prove the item was previously repaired and that I contacted customer support in Oct 08. However I was asked to prove that I had asked for an engineer to attend our home. I was informed that none of the previous repair history or our telephone calls reporting a further fault in the Oct 08 about the blu ray was passed onto our records from the previous repair company. My integrity was questioned.  I did speak with a staff member who&amp;rsquo;s identity I am not prepared to disclose until I have written assurances that their treatment and their job/career within the company is secured can testify that my treatment was degrading. The staff member can further evidence that my records on the computer had been lost and that a supervisor had blocked every staff member within the customer service department from using their discretion to authorise a replacement. The staff member acknowledged that since I had questioned a supervisor albeit professionally and calmly having pointed out an error of honesty that they had took an exception to me and made it their business to ensure my mistreatment.  I was ridiculed when I mentioned a disability I unfortunately have, by a supervisor who suggested I should not have rang up customer service until I was able to listen or speak sense with proof that I had reported the fault in Oct 08. I am a professional person and have never in my lifetime been treated with such disrespect. I am sure if there is justice those who I spoke too will let you know who they are by the barrage of comments they will have to say about me. If like me they tell you without oxygen (taking a breath of air) what a nightmare of a customer I was please take note of their demeanour and attitude.  I can say with total honesty that I never raised my voice nor was I rude or sarcastic nor was I at any time, unprofessional. So I accessed my credit report from experian and one entry stood out. It was for a MINT credit card which had been defaulted.Looking into the matter further I found out that after I had moved address there had been a payment out of the card for &amp;pound;36. After I moved I thought my balance was still at &amp;pound;0, which it was beforehand. Since then I have been receiving reminders to my old address about this payment and then finally received the forwarded mail to my new address (first I&amp;#39;d heard of anything). Which I paid immediately and was settled. The account defulated after 3 months and then was stafised the very next month. The credit report states "satisfied".  Now I know I should have either closed my MINT account down at the time or notified of my new address but I still feel that this mishap on my behalf is simply a mistake rather than me not being able to make the payments. As I said before I have had no late payments with any other cards or loans.  Is this something that I can argue to get this default lifted from my report? Or is it something that I can only really add a note to my entry on the credit report?  Also is this now going to affect me remortaging which I intend to do next year? I have spoken to BOS customer services manager and he has said they same I will have to pay the charges, he was quite aware that I had transferred the money and it was to the wrong acct, when i noticed my error which was last night I automatically put the money into the correct acct, but they are adamant there is nothing I can do about the charges as they refunded me a charge in July this year. I think this is pretty rotton of them considering they can see the money was there but in the wrong account.   Does anyone know of anything I can do apart from close all my accts with BOS which they will not be bothered about 1 person closing them. No much wonder they can afford to give out all the cheap loans that they do. It has far-reaching implications for you and me and means yet another major bank shake-up.  The government claim this means a significantly reduced risk for the taxpayer, but what do you think? Is this good news? Will it mean increased competition in the banking industry? Will you and I see any benefit?  In summary:  Lloyds Banking Group Lloyds, 43% of which is already owned by the taxpayer, has managed to avoid entering into APS but at a cost: it will have to pay the Government &amp;pound;2.5bn to simply avoid the scheme, sell-off 600 branches including the TSB brand and sell the Cheltenham and Gloucester mortgage brand and the online Intelligent Finance brand. They will also raise a further &amp;pound;21bn from a rights issue &amp;#39;swapping&amp;#39; debt for capital.  Royal Bank of Scotland RBS, unlike Lloyds, will enter APS - meaning &amp;pound;282bn of its assets will be insured by the taxpayer. There are other serious implications for the bank: it will cost them &amp;pound;700m per year to participate in the scheme and cost &amp;pound;2.5bn to leave. The government&amp;#39;s stake in the bank will increase to 84.4% (although its ordinary shareholding remains at 70.3%). All companies replied. Those who sent me a signed credit agreement, I have paid off either in full, or at an agreed settlement figure, and these debts are accurately recorded on my file. However there are a few who never replied and do not have my siganture, who have also recorded these defaults. My question is, how would I go about getting them to remove these? And is it possible? My thought is that it is against the data protection act, but I&amp;#39;m looking for some guidence before I go in all guns a blazing! But now all the correspondence concerning this debt is headed RBS (with no mention of Tesco).     Should I be looking for proof that this debt has been re-assigned ? Today we have received our statement and can clearly see the interest rate is variable and of course a lot lower than the rate of nearly 6% that we thought we had secured. Both my husband and I clearly remember the meeting we had at the bank and how we discussed with the lady that it was better to put our money into the ISA&amp;#39;s rather than pay off our mortgage because the rate was so good. She even talked about how we were lucky as although the rate had just dropped that we were had still managed to get a good one.  We went into the bank on the off chance that someone could see us today but they couldn&amp;#39;t and the manager we spoke to said that they were all variable and it would have said this in our welcome letter.  I definitely want to try and take this further as we both feel we were completely mis-sold these ISA&amp;#39;s. Has anyone got any advice or similar stories? We dont know whether we will be first or last,but do know that there will be a lot of stress,as we will be decanted out,other tenants will be decanted in etc,depending on where we come in the scheme.We have some savings which we could use to buy a house,but as we cant get a mortgage,we cannot find anything suitable,as we don&amp;#39;t have enough.. If we used our savings to buy a property using the open market equity scheme,would they take the proposed value of the flats in to consideration? It would mean we have no nest egg or savings if they did this.No one seems to know the answer I have asked the local estate agent but they just said it was means tested and they take everything in to consideration Another one told us that as we would be eligible for an equity share in the new build flats,then this should apply to a property on the open market as well,and as long as we could pay the equity share then they wouldnt take the sale of the flat in to consideration.Our total pensions come to &amp;pound;1300 a month,so we cant afford to lose the money from the flat .We have applied for Council housing,but until there is an actual demolition order on this block of flats,then we don&amp;#39;t have enough points for anything decent. Last month I paid off my credit card when I received my salary, this was about 4 days before my monthly statement came through. However last month my PPi payment was taken out between me paying the card off and the statement being produced, giving me a final balance of &amp;pound;7.01 and a minimum payment of &amp;pound;5. Unfortunately I didn&amp;#39;t realise this (my fault I know, should have actually read the statament property!) so now have a default (which I&amp;#39;ve since paid in my latest bill).  After doing a bit of reading I&amp;#39;ve realised that I may well have been mis sold the PPi anyway so I&amp;#39;m going to be making a claim on this basis. My question is.... If my claim against the bank for mis selling the PPi is successful will I have grounds for getting the default removed from my credit file as it&amp;#39;s there as a result of the PPi payment?   Also... what&amp;#39;s the best approach to take when looking to claim against mis selling of PPi?
