    DFS - unable to cancel order

    A couple of weeks ago we went into DFS and arranged purchase of 2 sofas and a chair on interest free credit. (this was on a saturday) The same day when we got home and measured up we realised that they would not fit into our lounge, so I rang the salesman the same day who said he would change the order and that we would have to come in to sign a new credit agreement. He said he would phone to tell us when the finance company had agreed the loan so that we could come in and sign the papers.

    We had not got a phone call, so I phoned again and was told that everything had been agreed and that we had to come in and sign the new agreement. We were given the impression that the suite would not be ordered until this was done.

    My husband then had his weekly hours cut by his employers (60 down to 40) and we, therefore, decided we could not afford the furniture.

    We rang the store who have said that the suite is now in the process of being made (even though we never signed the second credit agreement). They have said that if we wish to cancel the order we have to pay them 20% cancellation fee which equates to £360.

    When I have checked the purchase agreement it does not mention a 20% cancellation fee but does state in the salesman's handwriting 'cannot cancel'.

    Could anyone advise where we stand as we were under the impression that until we sign the correct finance agreement the purchase would be nul and void?

    I had a similar situation with them, where I tried to cancel, but was told I could not. I rang consumer advice lines and was told they were within their rights as I had signed for the goods, and the fact that I entered their premises and signed an agreement meant they were within their rights to make me honour the sale.

    They spun me the same story aboult it being made, or it had been allocated a slot which they cannot cancel etc which i think is how they get away with it.

    I think you will have to pay a cancellation fee if you do actually decide not to go ahead.

    I can only think that with any credit agreement you are given a cooling off period, but as it was 2 years ago I am a little unsure as to whether I queried that but I believe I did.
