My wife has come up with a rash that is covering most of her body. With cream from the Doctor things are improving. She is no longer sleeping on the new mattress. Has anyone else had a problem with a memory foam mattress. She is unsure about sleeping on the memory foam again. Before I go back to the shop I am trying to find out if this is a common problem. Thank you everyone.

DFS Credit agreement - where do we stand ?

Hi All New here but any advice would be gratefully received, We went to DFS last Wednesday, found 2 sofas we liked, sat down with the salesman and completed a credit application etc signed the credit agreement and went home and were happily waiting for our sofas to be delivered, that was until today, when my partner received a call from DFS saying there was a problem with the finance, he offered us two alternatives, either have a family member or friend fill in a new application that we would pay, or to pay a deposit and the outstanding balance when the sofa are delivered, we have just checked and as far a we can see, we have a signed credit agreement with DFS, and having the sofas on finance was the only way we could afford them. The salesman has already ordered the sofas and has indicated to my partner that we are still liable to pay for them even though he now say's the finance is not possible, does anyone have any idea where we stand ? Many thanks in advance for any help. LoL said they would give us a replacement, they then went bust. Administrators wrote to me to say they would not replace sofa. I claimed from my credit card and got a full refund. LoL wrote to say order now cancelled as refund given. Lol then sent me a card to tell me to travel to their wharehouse about 90 miles away and collect at my expense, new sofa that was now in stock. Now LoL have written to say, return original faulty sofa back to them. (I guess so that they can try to sell it again.) (this was on a saturday) The same day when we got home and measured up we realised that they would not fit into our lounge, so I rang the salesman the same day who said he would change the order and that we would have to come in to sign a new credit agreement. He said he would phone to tell us when the finance company had agreed the loan so that we could come in and sign the papers. We had not got a phone call, so I phoned again and was told that everything had been agreed and that we had to come in and sign the new agreement. We were given the impression that the suite would not be ordered until this was done. My husband then had his weekly hours cut by his employers (60 down to 40) and we, therefore, decided we could not afford the furniture. We rang the store who have said that the suite is now in the process of being made (even though we never signed the second credit agreement). They have said that if we wish to cancel the order we have to pay them 20% cancellation fee which equates to £360. When I have checked the purchase agreement it does not mention a 20% cancellation fee but does state in the salesman's handwriting 'cannot cancel'. Could anyone advise where we stand as we were under the impression that until we sign the correct finance agreement the purchase would be nul and void?

Land of leather

I bought a leather suite from Land of Leather last year, this was delivered at the end of December. There was a couple of marks on it at the time of delivery that I agreed to have fixed, this repair lasted five months when the marks started to return, I then noticed that the colour was coming off in other places. To cut a long story short they have agreed to refund but want to charge me a usage charge for the time that I have used the suite. I don't consider that I have had reasonable use of this suite as it has been faulty from the start. The inconviennce to me hasnt been considered ie I will be without furniture in my house while waiting for a new suite (between 10 - 12 weeks), My lounge has been decorated to match this suite. I feel I am loosing out because they have sold me faulty goods, can I insist on a full refund as the original fault was reported at the time of delivery and the other faults reported within five months. The ring was half price but they did not have my size in that branch. They said that they would get a ring transferred from another branch and I asked whether I would need to leave a deposit for the ring or pay for it in full to ensure that I paid the sale price. As it was the start of January they said that the ring would be in with about a week and there was no requirement for a deposit or to pay in full. However after two weeks the ring had not been sent (it appears that they forgot or something??) - they put a fresh request for the transferral and again I asked whether I would need to put a deposit to ensure that the ring could be purchased at the sale price (as I was then aware that the sale was coming to an end in about a week and made this point to the sales advisor). Again I was assured that they would honour the sale price and there was no need to worry. The ring took another two weeks by which time the sale was finished - I have just been to pick up the ring and been told that they will not honour the sale price - I am distraught because it was an engagement ring and as a result of the sale was half the original price (which is significant). Although my details are in their order book (dates / sale price of ring etc) they say that their staff 'conveniently' cant remember making these assurances - this was not just one staff member but two, on two separate occasions that made this statement. They have said that as a good will gesture they will give me 25% off the ring but not the original 50%. Does the above constitute a verbal contract - do I have any rights regarding the purchase of the ring that the sale price that was agreed verbally?

personal details supplied to a retailer.

when a contract between a customer and a retailer and the contract is signed by both parties,it states on the contract that all personnel information is private and confidential. if the buyer defaults on payment, does the retailer have the right to pass-on the buyer's personnel and confidential details to the debt collector or is the seller in breach of the contract?

Empire Direct Guarantee

Hi, I bought a TV from Empire Direct in Aug 2006 and bought their 5 year warranty for an extra £349 (in hindsight, I shouldn't of paid out for it!). The delivery guy arranged for the store to come out to change the faulty feet. This they did ( I had to take some time off work to allow the repair guy to do the work) About 2 months later the springs came off the frame and sank in the middle. Again I had to arrange for the upholsterer to attend to make the repair again taking time off work Then in October the lining began to come away from the arm of the sofa. I phoned the store to say that this was now unacceptable to have 3 call outs in the first 8 months of a Sofa life and asked for replacement sofas as I was totally dissatisfied with the quality of the sofas The manager of the Basildon store said that they were in warranty and that they would fix them during this period . I argued that that is not the point and I do not want to be taking a day off work every 2 months for the next few years whilst I have my sofas fixed. He continued to imply that it was not faulty workmanship but possibly that I had broke the sofa in some way as ‘it was unusual for this to happen’ and that my sofas were ex display models (which I hope they are not given it took 6 weeks for them to arrive I am pursuing for replacements but as I purchased these via finance and the repayments have not yet started am I within my rights to not pay citing that the goods are not fit for the purpose they were provided

returning brand new wii game to argos

hi i bought a brand new wii game from argos 10/12/08 still unopened and in original wrapper and sealed is it possible for me to get my money back as they are saying its at the managers discretion ... help please my daughter no longer wants it and i would like my cash back 2 get her something else..nichola

Cancel DFS Telephone Order

Hi, We have ordered a new sofa and two chairs from DFS by phone on Wednesday. I purchased two £10.00 iTunes gift cards for early christmas presents for my two sons from Morrisons Supermarket (they all sell these cards and others like Next etc) on Saturday 6th December. I wrapped them on the same day as purchase and they were presented them at my works christmas party. I let them open them and went to redeem them on the Itunes website. It came up with a message that the cards were not active and to return them to the retailer (Morrisons). I checked the receipt and it had a message at the bottom stating allow 24 hours for the cards to be activated. Disheartened I told my lads to wait. They have done, and by the morning of Tuesday 9th the cards were still displaying the same message on the itunes site. I went back before I went into work that morning and simply got dismissed by saying it was nothing to do with them, as far as they were concerned the cards were bought, active and they were unable to issue a refund, as they state, on the reverse, which is the case, but in small writing, somewhere amongst this big paragraph is a sentence which states they cannot be exchanged for cash or refunded and I should take it up with itunes. This I did I sent them an email detailing the cards numbers etc via their site and I have received a reply, from a gentleman called Vernon, who said indeed the cards were inactive and their records showed they had been purchased on 28th February 2008 ?? and asked me to fax them a copy of the original receipt and a copy of the front and back of the inactive cards. This I have done today. Through my emails and on my fax I have asked them for a refund. As the cards didnt work I purchased £20 via their own site. However I have received two emails, one from a Stephen, who acknowledged receipt of my fax saying "oh yes" the cards are now active and one from the original complaint handler, Vernon, appreciating my request for a refund, but that department says "no" and to redeem the original cards. Have I simply lost out here, I wished to buy £20 for my sons, have they gained now £40. In this time of economic downturn I simply cant afford £40 on downloaded songs! What, if anything should I say to Itunes...

Paid for Kitchen - Shop wants to increase price - Help!!

I went to a shop to purchase a kitchen & relevant appliances. I was happy with the price (after discount) and on that basis I made the purchase and paid by Mastercard. A few hours later, I got a call from the store saying that the discount that we were given had been too great and that they would not be able to privide the goods at that price. I have told them that as far as I am concerned I have a binding contract (offer, acceptance and all consideration has been paid). I know little about consumer law and am fairly sure that they are now contracted to provide me the goods at the stated price. My questions are: - Am I right that I can compel them to provide the goods at the stated price? - What happens if they just refund the money to my credit card without telling me. It would cost me much more to buy the goods elsewhere? - If they do mess me around, can I take this up with Mastercard? We left to go to the show which was roughly 70 miles away. 45 miles into the journey we were turned away by the Police in the middle of the contryside in the dark and told to head home as the road was shut due to a major accident and that it wouldn't be open for some time. Is ther anyway we can claim back off the credit card or Mastercard etc?

Nature's Laws and the making of pictures, by W.L.Wyllie

How can I buy a copy of this book. I would like to order something from a company based in Germany, however the purchase would be several thousand pounds and I don't want to find myself conned. I'm pretty sure it's genuine, but I'd like to be 100% sure. I don't have any payment protection on any of my accounts that I am aware of to cover any problems. I have a had a quick look on google for reviews and can't find any though not too surprised because of the nature of the product. Cheers! The finance was refused despite her having bought something from them before and paid in full. Because they refused credit she assumed that they could not have the settee. She however received a call saying that the settee had been ordered (the salesman said that this is not normally done without payment sorted out) and they said could she find find another way to fund the cost. Surely this is not right. She has no other way to pay for it and we think that as she was refused the finance they should not have ordered the settee. HELP!
