We are extremely pleased about this and only too happy to help - the Church are providing refreshments for all attending and the use of our Church and adjoining Church hall. We have made it absolutely clear that we do not wish to be paid anything for this provision - as a Church we are endeavoring to raise our profile in our community by working on the principle of 'give and you shall receive'. A dilema has now arisen - the management of the school (though not the reception class staff) wish to charge parents for attending this event. I have a number of queries: 1. Given the school has actually incurred zero cost in organising the nativity is it right they should charge anything? 2. The actual cost they wish to charge parents is £3.50 per ticket (a quite ridiculous amount I think). Is this sum too high and what would be a fair sum.

Rules in respect of job vacancies in a Local Authority run school

Does anybody know the chapter and verse with regard what rules are applicable to the advertising / creation of a job vacancy in a Local Authority funded School? I ask because my wife works part-time in a school and recenty enquired about more hours but was told there weren't any. Recently an elderly retired lady began voluntary work at the school helping children with their reading. A couple of weeks ago a colleague of my wife left the school (she was employed to assist a child with special needs). My wife is suitably qualified to assist a special needs child. The position that had become vacant was never advertised and the next thing that my wife new was that it had been give to the elderly lady who had come to do voluntary work. This lady is neither a qualified teacher, teaching asistant or has any special needs training. Things have been brought to a head in last day as staff at the school have discovered the elderly ladies husband is a close personal friend of the assistant head teacher. This smells of blatant nepotism and my wife, along with other colleagues, is very annoyed. It is also not the first time a job vacancy has either been 'created' or never advertised - only to be filled by a family member (the daughter of the head, daughter-in-law of the assistant head and both their husbands). Perhaps this is all legitimate but it all seems a little too close to home for my liking.

Parcelforce Clearance Ransom Charge

The Parcelforce clearance fee is not illegal, the way they collect it is illegal according to section 104, 104, 83 and 84 of the Postal Services Act 2000: It states there must be no intentional delay of your postal packet. HM C&E can obviously delay it to check contents and apply duty but after that the mail must be delivered promptly. Parcelforce are breaking criminal law in sections 83 and 84 which state: Interfering with the mail: postal operators (1) A person who is engaged in the business of a postal operator commits an offence if, contrary to his duty and without reasonable excuse, he— (a) intentionally delays or opens a postal packet in the course of its transmission by post, or (b) intentionally opens a mail-bag. They are also breaking criminal law under section 104 which states: Inviolability of mails (2) Anything to which this subsection applies shall have the same immunity from— (a) examination, or seizure or detention, under a relevant power conferred by virtue of this Act or any other enactment, (b) seizure under distress or in execution, (c) in Scotland, any diligence, and (d) retention by virtue of a lien, Subsection 2d above states that it is against the law to hold you packet by virtue of lien, this means holding it to ransom for payment of a fee, This is the important bit, Parcelforce will not deliver your parcel without payment of the HM C&E VAT and their Clearance fee. They are breaking the law, they must deliver your parcel without delay and invoice you for the fees. This is covered in section 105 of the act. They can charge a fee but it can only be obtained by civil action, this means if you don’t pay either of the fees - VAT or the clearance fee, Parcelforce can only take you to small claims court. Note: Parcelforce have paid the HM C&E VAT on your behalf, you no longer owe VAT to HM C&E and as such, you are not breaking the law by refusing to pay Parcelforce which is just a PLC with fat cats at the top. My anger at the clearance fee started three weeks ago August 2007. I telephoned everywhere and initially got nowhere, so I read the Postal Services Act. I refused to pay for my parcel and spoke to Lynn Gawthorpe at Parcelforce HQ 01908 687000. I quoted the relevant sections of the act and I was allowed to pick up my parcel without any payment. I have now made a complaint to the Police, if you speak to them at Morriston Police Station, Swansea 01792 456999 (ask for Morriston) you will add weight to the criminal prosecution of the Directors of Parcelforce. I have also made a complaint through the Postal Commission (regulators of the act) and you can add to this by speaking to Sean O’Hara on 020 75932100 or emailing him on sean.ohara AT psc.gov.uk with your information and parcel details. DO NOT PAY FOR YOUR PARCEL UNTIL IT IS DELIVERED IF YOU DISPUTE THE CHARGES IT IS YOUR RIGHT NOT TO PAY IMMEDIATELY

Dry cleaning ruined!

I put a Reiss jumpsuit into a drycleaners which they have ruined beyond repair. Amongst other things the additional VAT was never mentioned on the call, and until i received the receipt today i was none the wiser of this extra cost. What i am querying is whether i can cancel within the 7 day cooling off period. Essentially they witheld the property lists unless i agreed to waiver the cooling off period. Otherwise they would wait for 7 days to pass, and then provide the information to me. I waivered this over the phone and received the lists, which were not quite what i was expecting... I'm hoping that by some luck they have played with the law here a bit, and i can't waiver this cooling off period. The siutaion is... I am looking for property to buy. I placed my criteria on a website which emailed many different agents. I received a call from this company the following day, she explained the waiver, and told me if i wanted immediate access i would have to waiver it. Is this legally possible in this situation? Many thanks, John

Renting a room

Dear sir, I am working in a small orgaisation and my husband is unemployed. I was an employee of a Firm of Solicitors who closed due to various problems and the Partners have told their Insurance Company Zurich it was all my fault. They lied to the High Court claiming in their Affidavit I owed many millions of pounds worth of assets which is a joke and the Judge believed them and a Freezing Order was imposed on me and my wife last September. We were separating and selling the matrimonia home and a buy to let property but even though on one property it had exchanged contracts the Freezing Order stopped the sale, the deposit used to buy a property for my wife and two children aged 2 years old and 8 months old was lost and we have not been allowed to make mortgage payments, credit card payments for 6 months. We need at least £20,0000 for a solicitor to act on our behalf but we have no money and the Freezing Order simply stops us having any monies other than income support and hopefully housing benefit which has just been applied for. Does anyone have any idea as to how you can get legal assistance for a civil matter when legal aide does not cover this and no firm of solicitors will act on your behalf without monies on account. Emotionally not only is my life wrecked but that of my wife and my children as the simplest of things like my sons nursery payments are not allowed meaning he has been taken out of nursery and away from his friends. My neighbour, in the house adjoining mine wants to buy my house but i'd like to keep the garage. my question is what would be involved in splitting the land up,is this a simple thing for a solicitor to do at time of sale or should it be done well in advance of negotiating with the neighbour. Btw, she wants to turn the house into bedsits, something she has already started on with her own property. just looking for advice or ideas really. Thank's in advance.

Is this Fraud or Misconduct

I am being chased for a invoice by a the former partners/directors of a company that is currently in Liquidation and not yet been dissolved. They have set up a website with a similar name and are now putting that they are trading as this company. I have not been contacted by the Liquidator whose details I found on companies house records. The invoice they sent me is dated from when they were trading as limited company but has an address on different to any that was on any previous correspondence. Also there is no company details like number etc. I have also been sent this invoice 9 months after the date it was produced. The meta data shows on the file shows that invoice was produced nine months earlier on a computer owned by someone with the same name as one of the directors. The invoice has been sent in the name an employee/associate of the company and is implying that the invoice is from him. After little research I found that the address on the invoice was the home address of one of the former directors and did not match any contact details for the name on invoice. I am assuming that the invoice has been withheld from the liquidator as it was produced less than two months before the company was liquidated. The company has been in in control of the liquidator for over 6 months and they have not contacted me. I have also found out that all the 3 former directors and the employee/associate are directors of separate Private Limited company. On their website for bogus company it implies that they are still directors of the company. I am also sure that I am not liable for the invoice as I have had not received all the services they are invoicing for. I also have a contract signed on behalf of the company in question when they were limited and it distinctly states that they are a limited company. I also have email correspondence with from the employee/associate with the company name and number and address on. When looking through previous emails I notice that they started using personal emails without and company details. At the time I didn't think much of it. In hind sight this makes me suspicious that knew that the company was going to be put into liquidation. Is what they are doing legal and if not who is the best person or agency to contact? What should be my course of Action?

Employer being too demanding?

Hi, I work as a Parking Host (according to our company, it's cleaner's job, customer service job, security job and cashier's job in one) in Yorkshire. Our company operates 3 different car parks in the city centre and I work in one of them. There was a change in working pattern of all the Parking Hosts in our town last year, after (verbal) agreement accepted by us and the company, we basically switched to 4 on - 4 off shift pattern, with four 12-hour shifts at work and 4 days off. When we made this agreement, we accepted the company's scheme, which defines all 3 car parks in a town as a Cluster - that means, that if there are two of us working on our car park in one day and something happens in another one (somebody will get suddenly sick, etc.), one of has HAS to cover the affected site without questioning it. So let's get closer to my problem: What is happening now - the company is trying to save every penny on it's staff (they make huge profits every year anyway) and it dismissed 2 or 3 Parking Hosts. The situation now is, that every time one of us is either sick or on holiday, one of the car parks is unmanned and has to be covered by someone from another site. But our company stepped to another solution - they want us to cover 2 car parks at once. And how it is supposed to work? Well - right now I'm on my four 12-hour nightshifts in one car park, which is busy approximately until midnight. I also have an emergency response mobile phone from another carpark (which is approximately in 1 mile distance from my workplace) and my company wants me to WALK over there, DURING THE NIGHT by myself, if a customer needs sorting out. They also want me do go over there to do some duties. Now this town has a very busy nightlife, thanks to massive amount of students. I am just wondering - do they have the right to ask me to leave my original workplace, have a 15-minute long walk to another site across the whole Leeds city centre? Even if I am supposed to be a part of a cluster, do they have the legal right to ask for such things? Isn't that a breach either of my contract, or Health&Safety Act, or both? Is there any legal advice I can get easily and personally (I honestly don't know, if Citizen Advice Bureau can handle this)? They do ask for another things that are not in our contracts, but I still honestly believe, that they cannot do this. I am not even saying about the 'customer service' I am supposed to provide to the customers on our carpark, because everytime I leave, it takes at least 15 minutes to get back - if something happens on my carpark and it needs to be sorted out by myself personally, the poor customer must wait until I arrive - that's the strategy of my employer. I would like to write a grievance about this matter, but I honestly don't know, if such fight does make sense. I am a full-time international student of European Law at university (and thus I am not much acquainted with UK laws) and I am not the only one of the Parking Hosts, who complains about the manners of our employer. But it seems, that I am the only one, who is trying to sort this out, as my colleagues are too afraid to support me without showing them a proof, that we CAN actually change something. So, please - if there is someone, who can help me with this case, I would be happy if You offered me any solution to this, legal advice, acts and laws dealing with such matters, and so on. Thank You.

redundancy help??

Hi, I am being laid off as there is not enough work for me at the moment, my employer has told me he will let me know in 4 weeks if I will be made redundant or if there is work for me to come back to.. my questions are.. i have been at the company 2 years 11 months and 20 days so am i still in employment when i am laid off bringing my employment up to 3 years by the time the 4 weeks are up? and what kind of payment will i be looking at if i get made redundant and will i lose any of this entitlement if i choose not to come back after the 4 weeks?? I was registered as self employed from August 2008 until Feb 2009 so I now need to complete a self assessment. During this period I was paid a retainer of £2,900 per month by the company that I had previously worked for. I finished in feb and was registered as unemployed and claiming JSA since then until a few weeks ago. Is there any easy way of working out what my tax bill is likely to be around? I think I can deduct for working from home, electric bills, mobile, heating bill, car lease payments and fuel etc which will reduce the bill a bit. Is this correct? Thanks

Jobseekers allowance stopping if partner is working

Hi. I was wondering if you could help me clear something up. My sister now lives with her boyfriend and is pregnant. She has been working for the most part for the last 2 years or so. her boyfriend has basically never had a job and claims income based JSA. He has been told recently that because she is working (earning approx £25k per year) he is not entitled to claim. Surely he has a right to claim in his own right and her employment shouldnt affect his claim either way. He has been told by the job centre that he cant make another claim for 13 weeks (when my sisters baby is due so not ideal...) Hopefully he will have a job by then but I cant get my head around the fact that his benefits are affected by someone else having a job... Hope this makes sense!

New business looking for factoring company?

Hi, I recently started a recruitment company and am experiencing some cashflow issues. To cut a long story short I have more money going out than coming in, which is due to the delay in my clients paying their invoices. I am still working for the same company and Student Finance Direct requested the copy of my contract to help them speed up the decision about my eligibility for student support. The problem is, that when I asked my company for the genuine copy of my contract, I got a negative answer (they provided the letter as a confirmation of employment, though) - the lady working in HR department didn't even tell me the proper reason, why I shouldn't get a copy, she just said ''because we don't do such things''. Is there any law or legal act that would confirm my right to obtain the copy of my employment contract, or is the matter lost forever now? I got through the Data Protection Act, but I couldn't find any part suitable to support my cause... Many Thanks, Stan.
