As quite a young driver (aged 23) I&amp;rsquo;ve been trying to raise my no claims discount over the years. I&amp;rsquo;ve never been involved in an accident however have made 2 windscreen claims on my insurance due to vandalism.  The first was with Norwich union who once I made the claim RAC auto windscreens wrote back to me saying the insurance company wouldn&amp;rsquo;t pay out for it and owed them an extra &amp;pound;20. I was a little annoyed but with it only being an extra &amp;pound;20 paid it and left it as that. Last year I made a claim with swift cover for the same thing. Paid a &amp;pound;65 excess and didn&amp;rsquo;t think anymore of it. Now my policy is up for renewal swift cover have said I haven&amp;rsquo;t earned any extra no claims discount because of this claim! I was shocked and appalled by this. Having worked in home insurance in the past I know that insurance companies have to list any main policy exclusions which were not done at any point. I&amp;rsquo;ve contacted the complaints department which have said that  &amp;ldquo;Every insurer has a unique policy wording which outlines their business practices and although these can sometimes be long winded, it is the responsibility of the customer to ensure that they are happy with the details before buying a policy.&amp;rdquo; However isn&amp;rsquo;t it their responsibility to inform me of any big changes to the policy? I&amp;rsquo;ve said I wouldn&amp;rsquo;t even mind paying the difference in the claim as it was only something like &amp;pound;20. They&amp;rsquo;re not interested but I would like to peruse this further as think it&amp;rsquo;s incredibly unfair. I tried to get more information from the RAC but kept getting a call centre who never wrote the letter I needed to prove I had broken down and received a call out, they just kept sending me my joining letter.   The fines were then sent apparently to Court although I never received the date and time of the appointment and are now with a company called CSS who are writing to me with differing amounts on a weekly basis. I do not have one letter with the same outstanding amount on and actually paid one for &amp;pound;108.16 which they say was late and as such was sent back to court (again, I did not receive notification of a date and time) and now they want another few hundred pounds on top of that!   A baliff arrived today to take my car away and I said that I would pay the amount outstanding but it is a fortune and not the same as other letters I have received. He also told me to pay him in cash not send a cheque to the office as it would mean another delay.   I am not sure whether to pay this Baliff on Thursday in cash or not. They could come back and say I owe even more money. How much does it cost to go to court? Did they really go back to court? Who can I ask to look into this for me as when I call the company they do not seem very helpful at all nor know what they are talking about. Should I go back to The Parking Shop and speak to them? Write to the court? I am not even sure what court dealt with the issue. I am in a terrible state with this. To cut a long story short....   Wednesday Week 1:  The dealer provided me with details of monthly payments, deposit and part-ex. Initially the numbers were too high but they came back with a better offer. Booked a test drive for Saturday  Finished work early and managed to get to dealership in the evening. Test drove car. Was advised by dealer that they could get me a cheaper car to the same spec but would have to order it in. He said that if there was any problem with the car that they ordered in or I didn&amp;#39;t fancy it then I could have the one I had just test driven but he would have to sell it to me at a higher price.  I informed them that I could hand back my current car and asked if this would make a change to the finance. Dealer recalculated figures and provided me verbally the monthly payment figures.Dealer asked what he had to do to get me into the car.  I said I would think about it.  Friday Week 1:  Dealer telephone and re-iterated that there was a vehicle available as per the spec of the test driven car and would need to order it in. I was told that he needed a &amp;pound;500 deposit to put an order in with the supplier as he had to buy it. I agreed to pay a deposit and did so by credit card. I was not told that the deposit was refundable or not refundable and accept that I did not ask. They also took some details to prepare the finance quote. They asked for bank details but I didn&amp;#39;t have them. They said that they didn&amp;#39;t need them at that time.  Dealer called back later in the day and confirmed that they had ordered to car and that the finance had been approved (didn&amp;#39;t say by whom - I thought it was the finance manager, but, it was actually the finance company - I didn&amp;#39;t realise that they were actually submitting a proposal).  I was told that when I come in on Saturday that I should bring my driving licence and I would have a chat with the finance manager.  Saturday Week 1:  Went to the dealership with my family as I intended to make sure that the wife was happy with the car.  Took the car out on a test drive. Dropped the family back home and then went back to dealership as I knew I had to talk to the finance guy. When I got back I was told by the salesman that the finance manager had left for the day. I was told that he would call me.  Monday Week 2:  Telephoned the dealership to ask them to fax me the finance quote as I had not seen any paperwork (this included terms and conditions and neither had I signed anything). I also wanted a breakdown of what I was expected to pay and whether there were any hidden charges and what the APR was.  The dealer called me back and told me he didn&amp;#39;t know what the APR was but the monthly payments were X, deposit Y and that there was a Z option to purchase fee (this had not been mentioned before).  I was also told the car would be with them on Thursday.  I did my own calculations and found that the APR was something like 15%. I also checked the marques website and found out that the finance being offered by the same finance company for similar vehicles was nearer 12%, the option to purchase fee was less and so were the monthly payments.  I telephoned the dealer and informed them of this and told them that if they couldn&amp;#39;t get the finance down that I would not be proceeding.  (ok - hang on in there)  The salesman told me that I would need to talk to the finance manager and he was not around till Tuesday.  Later the salesmanager called me and provided details of a better deal for me and outlined the payments. I stated that this would save me N and was a better deal for me. Salesmanager re-iterated that he had ordered the car.  Tuesday Week 2:  Based on the numbers I had been provided I worked out what the finance would cost me and what my minimum liability would be to the finance company if I needed to terminate the finance. Based on my figures my view was that I couldn&amp;#39;t commit to such a large liability given the current job security and economic situation. The deal was over 5 years and I would have to pay back at least 50% of the finance to terminate.  Emailed the dealer informing them that I would not be pursuing a purchase.  Wednesday Week 2:  Called dealer and explained situation. I was then told that I would not get my deposit back.  Thursday Week 2:  Dealer called me back offering a different finance deal. I explained that I could not commit as previously explained.  Dealer kept trying to offer me different finance deals.  Got home in the evening to find out that I had a letter from the finance company telling me that my application had been approved.  Friday Week 2:  Emailed the dealer explaining that I didn&amp;#39;t know anything about a finance application and outlined what I wanted them to do. I was also concerned as to what my financial liability was as a result of this.  Called the dealer to be told that I was told at the time that a proposal was being made. They confirmed that I had no financial liability other than my deposit as I had not signed anything.  Regarding my deposit I was told that I would not get that back as he had ordered the car for me from the manufacturer used car pool and that he was now left with a vehicle he didn&amp;#39;t need and would lose money as a result.  The best he could do was offer to repay the deposit if he did not make a loss.  We agreed to leave it at that and not have any further discussion. He stated that he still wanted my business and I could use the deposit against another vehicle.  (ok - thanks for keeping with it - this is the home straight)   It is now Saturday Week 2:    Whilst I do want my deposit back - I appreciate that the dealer may lose money on this. Whilst I had not committed to purchasing a vehicle (my belief was that they were getting a vehicle for me to consider for purchase - remember I hadn&amp;#39;t actually seen the vehicle, I had not signed anything and had not been presented with Ts&amp;Cs either verbally or in writing) some form of contract must be in place as I have paid &amp;pound;500 deposit (on credit card - paid over the phone - customer not present - no receipt provided).  My concern is this: If it is viewed that I canceled and am therefore in breach of whatever contract may exist am I liable for anything else financially? Is my deposit sufficient to cover any claim that the dealership may be able to make against me? OR am I actually legally entitled to a full refund?  As I said, I&amp;#39;d like my deposit back. However, my big concern is whether the dealer can claim against me for loss of earnings etc.  Unfortunately, they don&amp;#39;t have any other vehicle available which would suit my requirements otherwise I would have agreed to purchase another vehicle from them. I appealed to a London Council against a parking ticket and (believing I had a good case) to it to the second stage of appeal.  However the Council have now raised the penalty fee from £50 to £100.   I have completed every stage on time, and by-the-book. The Council turned down my 2nd stage appeal and said the rise in penalty fee was applicable on the date they sent out the rejection letter (turning down my 2nd stage appeal).  This seems to be a clear £50 extra penalty for taking the appeal to the 2nd stage.  Despite believing I have a good case against the original parking ticket I wanted to call it quits and just pay the £50, but the Council won't let me, insisting I have to pay the full £100.  The Council said if I don't like it I can appeal to the adjudicator. I'm thinking of doing this.  Can I appeal to the adjudicator on grounds that the rise in fee is against natural justice? Does this count as a procedural impropriety? After 100 miles, I get a flat tyre and the electronic engine management light comes on. Bad start. This car is under a one year guarantee. I do not wait and take the car immediately to the garage to avoid further problems.   They check the car and right away they spot problems in the electrical system, airbag system and the brakes, just to mention a few (the list is one-page long). Although this seems a lot, I wasn&amp;#39;t able to spot it even after thorough inspection when I bought the car, without the proper equipment. In that state, it is dangerous and clearly has no chance of passing the MOT. The car shouldn&amp;#39;t have been sold. The problem is that the car passed the MOT a week before I bought the car (which helped me to think the car was OK) but I doubt the validity of that so-called MOT. I suspect there is some business going on between that car dealer and the MOT centre.  But back to the point, I want my money back. Obviously, he doesn&amp;#39;t agree. He clearly knows that the car was not usable. I went to a car dealer especially to avoid a dodgy deal, thinking it&amp;#39;s safer than dealing with a private seller. Clearly I was wrong, point taken. Also, given the fact that this is a business, the dealer is registered and I guess has to comply with some rules aimed at protecting the customer. This is precisely what I&amp;#39;m not sure about: what&amp;#39;s the dealer&amp;#39;s responsibility in such a fraudulous sale? Can I claim my money back on legal grounds? And last but not least, who should I talk to after the car dealer doesn&amp;#39;t want to reach an agreement? I&amp;#39;ve seen vague different answers: trading standards, police, solicitor, etc.. but not being originally from the UK, I&amp;#39;m a bit confused as to what&amp;#39;s the best thing to do. There are parking bays for all residents, but none for visitors. Until this week, there has been no signs or warnings to say that you cannot park on the road side. There&amp;#39;s no road markings either. Anyway, there is now a sign up warning people that this is private land and by parking here you are agreeing to the &amp;#39;contract&amp;#39; of being charged with an &amp;pound;85 fee, reduced to &amp;pound;60 if paid within 7 days, but increased to &amp;pound;140 if late! I wasn&amp;#39;t expecting a no parking sign as i&amp;#39;ve always parked there and if I&amp;#39;d seen it, I would most certainly not have parked there! I feel that this is an extortionate amount of money to charge and considering the circumstances unfair. If it was &amp;pound;20 or &amp;pound;30 I probably would have befrudgingly paid it, but it&amp;#39;s a private firm and the amount is huge. I simply cannot afford to shell out &amp;pound;85 for an innocent act.   On the backof the receipt it states that they won&amp;#39;t deal with multiple appeals, that i must state my name and address if I appeal, and that they can request info form the DVLA should I not cooporate. It also states that if the Parking Notice is presented in front of a Police officer, it is important that the officer doesn&amp;#39;t discourage payment. This last bit smells a bit fishy to me.  Also, I have read that with it not being a council run area or company, that the driver is liable, not the owner of the car. But if i leave it, I fear that the bailiffs will be paying me a visit in a year or so, with an even higher charge. Or even worse, an appearance in court!   Are there any loop holes and what is my obligationj into paying this ticket? Here is my situation, I own two vehicles one a GMC Astro Safari van, up until today my main mode of transport fully taxed, insured, mot&amp;#39;d and all the legal stuff. Driving home last night my Astro developed transmission problems, and early today my Astro was RAC recovered to my local garage.   The upshot is major repairs and VOR for some weeks, now I&amp;rsquo;m stranded and my only option is to put back on the road my other car which has been garaged and declared SORN since April. This is extremely important as I have a very important meeting tomorrow which I can&amp;rsquo;t afford to miss.   So having got a lift home from my local garage, I set about insuring my car on the internet, this I do at a cost of somewhere in the region of &amp;pound;160 OK fairly good. But I cant get a copy of the insurance certificate, which can only be sent out first class post, a bit of a wing and a prayer to tax the car as I need to be on the road by 10-30am in the morning and post is not usually received until around 11-00am. Initially I was told that a copy could be emailed to me, but later I was told that this could not be done. Stressed and frustrated now I focus on the next stage which is to get my car mot&amp;#39;d which very coincidentally expired yesterday. I make an appointment with my local garage and take the shortest route to the garage, car passes mot test easily, so now I only need to tax my car.   I am reminded that I can tax my car online, and think ahhh yes this will alleviate my worries of driving legally. My insurance policy {Liverpool Victoria} came into force today 19th November 2008 at 14-30hrs. At 18-42hrs I endeavour to tax my car online with the DVLA web site, however at this time the insurance database had not been updated with my policy, even though I have been given a policy number {214********} and I am not allowed to tax my car online, furthermore as I have been declined the car tax online I cannot reapply within the next 24 hours.   So here I am tonight I have paid for my insurance effective from 14-30hrs today and of course this will expire at 14-29 in twelve months time. I have paid for my mot today which again will expire in one day under twelve months 18th November 2009. I need to use my car tomorrow 20th November 2008 which I may not be able to tax even though I am quite prepared to tax this vehicle effective as from 1st November 2008   So my point is that surely with today&amp;rsquo;s technology, insurance online, electronic mot registration, and online car tax, It should not be too difficult for some &amp;lsquo;egghead&amp;rsquo; to synchronise these procedures so that you get what you pay for, and get it when you pay for it. It can&amp;rsquo;t be too difficult to update a database as and when a payment is cleared surely. Remember the technology is out there, number plate recognition will determine if a vehicle is taxed and insured within three seconds. To which the broker recalculated her premium with the current APR they offer giving her a premium total of around &amp;pound;1100 or so.  All fine so far... now it gets interesting, she asked if they could send her the details out in the post so she could check them over, and also as she didn&amp;#39;t have the funds to pay the deposit on the monthly payments deal until she was paid a week later. The broker was reluctant to let her leave the call without taking payment from her - she said she needed to provide payment details on the spot as the "low" premium would likely rise if she was to wait a week.My girlfriend repeatedly said even if she gave her debit card details there were no funds to clear the payment... to which she got the response "What about a credit card?" she doesn&amp;#39;t have one, and reiterated she would like to pay after she got paid... instead the broker said she would have to put her on a &amp;pound;0 deposit deal, to which my girlfriend reluctantyly replied ok...     Anyway - my girlfriend told me about this conversation when i got home from worked - as she felt she had been backed into a corner and not really had a chance to consider her options. I also thought that the insurance quote was rather high, lookin at Swintons website direct was nearly &amp;pound;500 cheaper!!!  Now - i think she is within her rights to cancel this policy, as at the moment, the insurance hasn&amp;#39;t become active, no payment has passed and my girlfriend hasn&amp;#39;t signed anything. Now she phoned the office to complain that she had been pressured into buying, unfortunatly the person she spoke to was the same person who pushed the policy in the first place, she took offence to the remarks, and demanded &amp;pound;65 to cancel the policy to cover the expense they have incurred already.   Is this correct? My girlfriend was sure that the broker mentioned a 14 day cancelation period... from the date of contract. The main question is has the contract become active? As no payment has passed, and cover has not yet started i dont see how it could have?   If someone could advise her rights in this situation i would be most greatful.
