    Hi Huxley,

I'm not sure what research you have done, or if you have been on another similar formu (Moneysavingexpert.com) as they have the templates on the reclaiming and also advice and updates on the court case.

If you are in financial hardship these cases are supposed to being considered outside of the hold that has been put in place.

It might be worth talking to your local Citizens advice to see what steps you can take, before going down the route of court etc.

The CAG (Consumer Action Group) is another good website for the fight back!

bank charges refund refused by barclays despite proving financial hardship

I would like to know the next step in trying to get Barclays to acknowledge our claim for outrageous business bank charges, back. They keep taking paid referral fees but will not give us a proper overdraft facility. The charges make us overdrawn and they then begin the whole process of charging us for their charge induced overdraft.
We are in arrears with our mortgage and utility bills but Barclays have told me today that they don't consider our charges are unfair or should be refunded. They even state in their letter that the High Court ruling supports their position on this. I have written today, stating that we will take them to the county court as the charges are unfair and ignoring our financial situation flies in the face of the waiver direction.
Is it likely that we will have to take them to court and can they just ignore our financial plight ?
